www.truly.co.uk (together with any successor or replacement URL, the “Website”) is a website operated by Truly Group Limited ("Truly") a company registered in England and Wales under company number 10355694 with registered office at Network House, Third Avenue, Globe Park, Marlow, Buckinghamshire, United Kingdom, SL7 1EY (VAT Registration number GB 254 2166 20).
These are the terms and conditions (“Terms”) that apply when you:
• use the Website
• make a purchase from Truly. If you purchase a gift card or electronic voucher, the Truly E-Gift Card Terms set out below will also apply
Please read these Terms carefully. By using the Website, you confirm that you accept the Terms in respect of your use of the Website and that you agree to comply with them. Please make sure anyone visiting the Website through your internet connection is aware of these Terms. If you do not agree to these Terms, you must not use the Website.
By placing an order with Truly via the Website, you agree to be legally bound by these Terms, and confirm that you are at least 18 years old. If you do not agree to these Terms, you must not use the Website to make a purchase from Truly.
Truly’s Privacy Policy explains how Truly collects and uses your personal information.
The Website, and all products displayed on it, are directed at, and intended for, users/customers residing in the UK and comply with applicable UK laws. Truly cannot guarantee that content or products available on or through the Website are appropriate for use or comply with applicable laws outside of the UK.
HOW THE CONTRACT IS FORMED BETWEEN YOU AND TRULY
After you place an order via the Website, Truly will send you an order acknowledgement email summarising the products you have ordered. This email does not mean that Truly has accepted your order – at this stage of your order Truly is busy carrying out the checks explained below.
After sending your order acknowledgement email, Truly checks that it can fulfil your purchase (e.g. that the product you are ordering is in stock), there are no pricing errors on the Website or any problems with the payment details you have provided, and you have passed anti-fraud, credit and security checks.
Truly works hard to try to ensure that all images and details appearing on the Website are accurate at the time you place your order, however, Truly is unable to accept your order if an error is discovered as part of order processing checks.
Truly will contact you if it can’t accept your order; in such circumstances you will not be charged for your order.
You will receive an order confirmation email from Truly once Truly has completed its pre-contractual checks, taken payment and formally accepted your order. The contract between us is formed at the time we send you that order confirmation email.
When Truly has dispatched your order you will also receive a dispatch confirmation email together with an invoice. For information on how long it usually takes your order to reach you, as well as any applicable order cut off times, please see the Delivery section of the Website.
If Truly accepts your order, Truly will take payment via the method you chose on the Website.
If you order products from the Website for delivery outside the UK, they may be subject to import duties and taxes. The total price payable for your order may include any applicable:
• VAT, goods and services or other sales tax chargeable on the sale, and may also include our estimate of import duty, customs clearance fees and other costs likely to be incurred in connection with importing your order (collectively "Import Fees"); and
• shipping and handling fees.
Our prices don't include any charges made by the payment provider you choose to use (such as PayPal, Klarna or bank fees).
Truly accepts a variety of payment methods, including major credit cards, PayPal, Klarna and other online secure payment platforms. By placing an order with Truly, you authorise us to charge your payment method for the total amount of the purchase.
If Truly encounters issues processing your payment, such as declined cards or insufficient funds, it will notify you. Truly reserves the right to cancel your order if it is unable to successfully process your payment.
All transactions on the Website will be processed in your local currency. Truly takes all reasonable care to ensure that all details, descriptions and prices of products and services appearing on the Website are correct at the time when the relevant information was entered onto the Website. Whilst Truly endeavours to keep the Website as up to date as possible, the information given on the Website at any particular time may not always reflect the position exactly at the moment you place your order.
Truly cannot confirm the price of your purchase until your order is accepted and you receive an order confirmation email.
Images and measurements on the Website are for illustrative purposes only. Whilst Truly has made every effort to portray product(s) on the Website accurately, slight variations may occur. All measurements are approximate and colour representation and reproduction are dependent upon publishing processes and the set-up of the device upon which you are viewing the Website. Size charts are available in the “Size Guides” section of the Website.
Please note that, unless otherwise stated, all measurements and product descriptions on the Website are based on standard UK sizes/dimensions. You are solely responsible for checking that a product is the size and type that you want prior to ordering it.

All dates quoted for delivery are estimated delivery dates only and may be subject to change. Truly does not accept liability for any loss or damage (whether direct or indirect) if delivery takes place at any time other than the estimated date for delivery.
SHIPPING AND IMPORTATION (ORDERS OUTSIDE OF THE UK)
If you place an order that requires Truly to facilitate the import of one or more products to your delivery address:
• you are the importer of record for any products you purchase, and you are responsible for ensuring that your use and import of the products complies with any and all applicable laws and regulations;
• you acknowledge that your order may be subject to import duties and taxes, you will be responsible for paying these charges in accordance with any instructions you receive from Truly, the delivery company or another third party;
• you authorise a licensed customs broker chosen by us to act as your agent and to deal with foreign revenue authorities to clear your merchandise, account for duties and taxes on your behalf, return your merchandise, and if applicable, prepare and submit refund claims on your behalf for any products that you return;
• Truly may give you the option to not include an estimate of Import Fees in your order price total. If Truly provide this option and you choose to make your purchase exclusive of such Import Fees, you agree and acknowledge that the actual Import Fees may be more or less than any estimate appearing on the Website, and that you are responsible for paying any and all actual Import Fees levied by the shipper or customs broker to facilitate the import of one or more goods to satisfy your order and procure delivery of such products to your delivery address and we are not responsible for this;
• you agree that any purchases you make from the Website are strictly for non-commercial use, and that you are not permitted to resell any products. Further, by purchasing from the Website you confirm that the items you are purchasing via the Website will not be re-exported, sold, or transferred in violation of any applicable laws; and
• you acknowledge that any products purchased from the Website are manufactured and marketed for sale in the UK and comply with applicable UK laws. Truly cannot guarantee that content or products available on or through the Website are appropriate for use or comply with applicable laws outside of the UK.
For orders placed for delivery within the UK, title (by which we mean ownership in legal language!) to the product(s) you purchase via the Website will transfer from Truly to you at the time that Truly has confirmed its acceptance of, and received payment in cleared funds for, your order.
For orders placed for delivery outside of the UK, title (by which we mean ownership in legal language!) to the product(s) you purchase via the Website will transfer from Truly to you at the time that Truly has confirmed its acceptance of, and received payment in cleared funds for, your order prior to the product(s) you ordered being passed to the relevant carrier for delivery to you. The transfer of ownership to you needs to happen in this way so Truly can make sure all of the international taxes, import duties and shipping charges are dealt with in the way Truly agreed when you placed your order.
Should you change your mind you can cancel your order or return a Truly product (provided the product is in its original condition):
• at any time before you receive our order confirmation email; or
• at any time within 35 days from the day the product was delivered to you.
Unfortunately, if you change your mind, you cannot return:
• opened or used cosmetic products, pierced earrings and other pierced body jewellery or any other applicable products, due to health and hygiene reasons;
• underwear/lingerie, hosiery and swimwear where the hygiene strips or garment tags have been removed and/or if the item is soiled, due to health and hygiene reasons (such items should be tried on over underwear to ensure compliance with this provision);
• products personalised for you or made to order, due to the bespoke nature of these products;
• fragrances once their original packages have been opened; or
• products which no longer have their garment tags and care labels attached and/or are not in their original re-saleable condition.
All products are inspected on return. Products must be returned in their original packaging in a pristine condition. If a product is returned to Truly without its garment tags and care labels attached, damaged, worn or in an unsuitable condition, Truly won't be able to give you a refund and may send the product(s) back to you at your default delivery address (at your cost).
If you return an unwanted product or cancel because you’ve changed your mind in accordance with this policy, Truly will refund the price of your purchase together with any applicable standard delivery charges (but not any overseas/international shipping costs or enhanced or premium delivery charges that you may have selected).
You must ensure that you return the product within the 35 day returns window stated above. Returns received by Truly outside this timeframe may be accepted at Truly’s discretion and may be refunded as a gift voucher or will be returned to you at your default delivery address (at your cost).
Please ensure that you fully complete the returns form emailed to you when you placed the order and send it back with your returned product, otherwise Truly will not have all the information it needs to process your return.
Please see the “Returns and Exchanges” section of the Website for how to print a returns form. You can also get assistance with your return by emailing help@truly.co.uk, or by contacting Truly’s customer service team via the live web chat service available on the Truly Website.
All returns of products ordered for delivery to the UK are free, and once your return has been verified and accepted by Truly you will receive your refund within 14 days of Truly receiving the product back from you, or your cancellation notice (if Truly hasn’t completed your order/dispatched your products). If you are returning a product to Truly from outside of the UK, you will need to pay the return costs, unless Truly is required to pay such costs by law. Please email help@truly.co.uk or contact Truly’s customer service team via the live web chat service for help on returning a product to Truly from outside of the UK.
Any return product is your responsibility until it is received back by Truly. Unfortunately, Truly is unable to refund any product that is lost or damaged during its return back to Truly. To help you to ensure that your return reaches Truly, it is recommended that you use a tracked or registered delivery service and make sure the return product is packed properly so it doesn’t get damaged.
Truly is not responsible for any product or other items that are sent to Truly by mistake or were not purchased from Truly. If Truly is able to locate any item returned in error (which may not always be possible) and you would like it returned to you, Truly may do so (at its discretion) and you must cover the return postage cost.
Please be aware that Truly products purchased through John Lewis or Next can only be returned to John Lewis or Next (as applicable). Truly is not able to assist with issues on orders related to these retailers, so please contact them directly or refer to the applicable retailer’s website for assistance.
Nothing in these terms affects your statutory rights.
If a product you have ordered from Truly is defective/develops a fault or is incorrectly described, you have a right to a refund or an exchange provided that you inform Truly within 35 days from the day that product was delivered to you.
Subject to the defect/fault being verified by Truly, Truly will refund you the price of the defective/faulty product along with the delivery charges you paid.
If you wish to return a product because it is faulty, please email help@truly.co.uk or contact Truly’s customer service team via the live web chat service available on the Truly Website. Truly will then provide you with instructions on how to return the product.
If a defect/fault develops outside of the 35 day return period, please email help@truly.co.uk or contact Truly’s customer service team via the live web chat service available on the Truly Website to agree the best way forward.
Products with faults/defects caused by accident, neglect, misuse, normal wear and tear or which otherwise fall outside the terms of Truly’s warranty cannot be returned and will not be covered by Truly’s product warranty. If you return something to Truly which isn’t actually defective/faulty, Truly reserves the right to return it to you at your expense.
Please make sure you return any faulty/defective product as well as all original packaging. You also need to ensure you have fully completed the returns form emailed to you when you placed the order, otherwise Truly will not have all the information it needs to process your return. Please see the “Returns and Exchanges” section of Truly’s Website for how to print a returns form.
Truly may reject or reduce your refund if you do not comply with Truly’s returns instructions and requirements.
Any return product is your responsibility until it is received back by Truly. Unfortunately, Truly is unable to refund any product that is lost or damaged during its return back to Truly. Truly offers electronic gift cards for purchase from the Truly Website –referred to in these terms as a "Truly E-Gift Card".
HOW CAN I SPEND MY TRULY E-GIFT CARD?
You can use a Truly e-gift card to buy anything listed on www.truly.co.uk apart from another Truly E-Gift card. You can also use your Truly E-Gift card to purchase something of higher value than your Truly E-Gift card balance, provided you pay the difference via a second payment method.
HOW MUCH CAN I SPEND ON BUYING A TRULY E-GIFT CARD?
You can purchase a Truly E-Gift card for any value of credit from £5.00 to a maximum of £500.00. Each Truly E-Gift card has a unique reference number which is provided following purchase together with details of how to use and redeem the credit amount of the Truly E-Gift card.
HOW DO REFUNDS WORK WITH A TRULY E-GIFT CARD?
If you make a purchase using only your Truly E-Gift card and then receive a refund or exchange of that order, any refund will be credited back to you as a Truly E-Gift card. If you purchase something from Truly using a combination of a Truly E-Gift card and a second payment method, any refund of that purchase will first be credited back to your Truly E-Gift card. If the amount to be refunded to you exceeds the amount you spent using a Truly E-Gift card, then any remaining balance will be refunded to the second payment method you used.
DO TRULY E-GIFT CARDS HAVE AN EXPIRY DATE?
A Truly E-Gift card can’t be cancelled, exchanged for cash or sold to someone else, and will expire two years (24 months) from the date of issue.
E-GIFT CARD TERMS
Truly E-gift cards remain the property of Truly Group Limited. Risk in a Truly E-Gift card shall pass to you upon our electronic transmission to you; in the event of misuse or fraud Truly reserves the right to cancel a Truly E-Gift card.
If you lose or someone steals your Truly E-Gift card electronically, unfortunately Truly cannot replace it. You agree that Truly will not be held responsible for any lost balance as a result of electronic theft or fraud, unless this is caused by Truly.
Truly E-Gift cards supplied by this website are in £ sterling. Truly E-Gift cards are not transferable or redeemable for cash or credit.

Your statutory rights are not affected by these Terms.
IN NO EVENT SHALL TRULY’S AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS, WHETHER ARISING OUT OF OR RELATED TO BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, EXCEED THE AMOUNTS PAID BY YOU FOR THE PRODUCTS SOLD TO YOU THROUGH THE WEBSITE.
Truly does not exclude or limit its liability to you if it would be unlawful to do so. This includes liability for death or personal injury caused by Truly’s negligence, fraud, or breach of your consumer rights.
Truly only supplies products and services for domestic and private use; consequently, Truly does not accept liability to you for any loss of profit, loss of business, loss of earnings, business interruption, or loss of business opportunity.

TRULY CONTENT CONTRIBUTION TERMS & CONDITIONS
By using the hashtag #TrulyFamily (or any variant thereof) and/or tagging Truly in any Content (as defined below) on any one or more Platforms (as defined below), you irrevocably and unconditionally agree to the following:
• You grant Truly Group Limited (England and Wales CRN: 10355694) trading as Truly (“Truly”), a royalty free, irrevocable, perpetual, sub-licensable, worldwide licence to use your social media handle and all and any digital content or other contribution (including your social media photograph(s), video(s), story, Gif(s), Memes, caption(s) and/or any other form of digital content) in relation to which you have used the hashtag #TrulyFamily and/or tagged Truly in (the “Content”), for the purposes of Truly’s marketing and/or advertising in any form or medium, in Truly stores and in Truly’s business and activities (commercial or otherwise) (including but not limited to bricks and mortar and online stores, solus stores, franchise stores, wholesale stores, any other stores selling ‘Truly’ branded goods and services and store-in-store concepts), and on the www.truly.com website or any other website, in Truly emails and newsletters, on any social media account (including but not limited to Instagram, Facebook and Twitter) or other online platform utilised by Truly or any of Truly’s authorised partners and licensees (each and any a “Platform”).
• Truly may (and licence to any third party the right to) use, reproduce, distribute, combine with other materials, alter and/or edit the Content in any manner in its sole discretion, with no obligation to you whatsoever.
• You hereby represent and warrant that (i) you own all rights in and to the Content, (ii) you have permission from any person(s) and/or brands appearing in your Content to grant the rights granted under clause 1 above, (iii) you are 18 years or older, and (iv) any use by Truly or its licensees of the Content will not violate the rights of any third party or any law. You undertake to notify Truly immediately in the event that you become aware that you have breached, or may have breached, any representation/warranty given in this clause 3.
• You hereby waive any moral rights in the Content to which you are now or may be at any future time entitled under Chapter IV of Part I of the Copyright Designs and Patents Act 1988 or any similar provisions of law in any jurisdiction.
• You hereby release and discharge Truly and its licensees from all and any obligation to pay you for any use of all or any Content, your name, likeness, image and/or any other identifier of you or any other person or brand appearing in any such Content and any of the intellectual property rights contained therein in connection with the uses described above.
Truly shall comply with all applicable data protection laws. By uploading or otherwise contributing Content to any one or more Platforms, you warrant and represent that you have obtained all consents required under applicable laws to supply any personal data included within any Content and to enable you to grant the rights pursuant to these Terms and Conditions.
You are aware and understand Truly’s Platforms are open to the public; by uploading or otherwise contributing Content to any one or more Platforms, such Content may automatically become publicly available on Truly’s page/feed on such Platform.
You hereby release, discharge and agree to hold Truly, its licensees and any person acting on Truly/its licensee(s)’ respective behalf harmless from all claims, demands, and liabilities whatsoever in connection with use of any Content.
These Terms and Conditions shall be governed by English law.
Promotional codes are only valid on full-priced items and cannot be used on sale or marked-down items which are already discounted or in conjunction with any other voucher or promotional code.
Promotional codes cannot be redeemed against or in conjunction with gift vouchers/giftcards.
If you return a product to Truly that was purchased using a promotional code, your refund will take into account the promotional code/discount used and received on the order.
Promotional codes are valid for the use and limited period of time as specified in the marketing communication/the terms of them; they cannot be used outside of that period and are not transferable or redeemable for cash or credit. All promotional codes are for use by the intended recipient only and proof of entitlement may be requested. Any improper use of a promotional codes may result in the cancellation of your order.
To apply a voucher or discount code to your purchase, you must enter the voucher/code at the checkout prior to completing the order.
